通过与“社会性合约”理论的对话，对比四个不同性质的农业用地经营权流转合约，提出一个“关系嵌入合约”的分析框架，并解释农地承包经营权流转合约的形成与执行逻辑。在利益结构、约定人结构和控制能力等因素的约束下，村域中的社群关系对合约发生了不同程度的嵌入效应。如果社群关系能够有效嵌入，合约方就会采取降低合约规范性、让渡合约内利益、容忍违约行为或侵权行为等方式，建立、换取和维护正式合约外的合作与信任关系。
通過與“社會性閤約”理論的對話，對比四箇不同性質的農業用地經營權流轉閤約，提齣一箇“關繫嵌入閤約”的分析框架，併解釋農地承包經營權流轉閤約的形成與執行邏輯。在利益結構、約定人結構和控製能力等因素的約束下，村域中的社群關繫對閤約髮生瞭不同程度的嵌入效應。如果社群關繫能夠有效嵌入，閤約方就會採取降低閤約規範性、讓渡閤約內利益、容忍違約行為或侵權行為等方式，建立、換取和維護正式閤約外的閤作與信任關繫。

According to a dialogue with the theory of ＂social contract＂, and contrast four different kinds contracts of contracting management right about agricultural land, the authors propose a analysis framework of ＂relations embedded contract＂, and explains the logic of the contract formation and execution. In the constraints of interest structure, agreed people structure, control ability etc, the community relations in village domain produced different degree of embedded effect to the contract. If the social relations can effectively embedded, contract parties will take reducing contract specification, conceding contract interests, tolerating the noncompliance or tort etc, to establish, exchange and maintain a cooperation and trust relationships that outside the formal contract.
