网络监督作为一种新兴的监督形式，已经对中国的政治、经济、社会等方面产生了不可忽视的积极影响，但在实践中网络主体在言论自由、行使监督权利的同时遭遇法律困境。需要从法律上承认网络监督的权利，建立对网络舆论监督主体权利保护的立法原则：权利保护优先、最少限制和事后追惩原则；健全与完善相关法律，尽快出台《新闻法》，对《刑法》和《国家赔偿法》相关条款进行修改，以保障公众的网络言论自由与网络监督权，实现网络监督的法治化。

Network supervision, as a kind of emerging supervision method, has exerted importantly active impact on China＇ s politics, economy, society and so on, in the practice, however, network subject encounters legal predicament while implementing freedom of speech and supervision rights, as a result, the right of network supervision needs to be legally acknowledged, legisla- tion principle for the protection of network opinion supervision subject should be established such as giving priority to right protec- tion and least limit as well as punishment afterwards, the related laws should be set up and perfected, News Law should be prom- ulgated as soon as possible, and the related provisions in Criminal Law and State Compensation Law should be revised to ensure public network opinion freedom and network supervision right implementation and to realize network supervision legitimization.
