环境责任保险自产生以来就以其独特的优势从环境损害风险社会分担机制中脱颖而出。作为侵权责任社会化的有效途径之一，拥有坚实法理基础的环境责任保险制度对传统民事侵权法理论提出了严峻的挑战，促使其在无过错责任原则、因果关系推定原则、不完全赔偿原则等方面积极做出调整，藉以应对日益严重的环境侵权问题。环境责任保险制度对环境侵权实行经济与法律的综合控制，弥补了现有法律制度在环境权益保障方面的不足，具有重要的法律意义。
