我国已经进入环境风险的高发阶段，特别是重金属污染危害人群健康，影响社会和谐稳定。作为一种新型的复杂性侵害，环境侵害是对多重利益、多元价值的复合性侵害，也是现代风险社会的必要代价，因而亟需构建和完善包括国家赔偿责任制度在内的环境侵害行政救济制度，特别是环境侵害行政补偿制度，以解决环境侵害救济中的政府法律责任缺位问题。

China has already entered the high stage of the environmental risks, especially heavy metals pollution endangering human health, affecting social harmony and stability. As a new complex infi＇ingement, environment infi-ingement is on multiple interest, multiple value of composite damage. It is a necessary cost of modem risk society. So we must construct and perfect the system of national compensation, including administrative remedies, especially the administrative compensatory system on environment infringement. The purpose is to solve the absence of government liabilities of administrative remedies on environment infringement.
