惩罚性赔偿滥觞于英美法系国家，且近几十年在美国已备受争议。在我国，惩罚性赔偿还是个新鲜事物，《侵权责任法》在产品责任中的惩罚性赔偿规定使得其成为了学界的焦点。惩罚性赔偿金的计算标准是研究惩罚性赔偿重要问题之一。本文在介绍我国法律中惩罚性赔偿金计算标准的基础上，对各个不同标准进行了评价，并提出了完善的建议。

The punitive damage originates in the Anglo-American law system countries, and it has been questioned by many scholars in American during recent decades. However, the punitive damage is a new system in our country, which has become the focus of the academic world due to the stipulations of punitive damages in the product liabilities of the Tort Law of the People＇ s Republic of China. The calculation standard is one of the important parts of the punitive damages. This article introduces the calculation standards of our country, evaluates the different standards and puts forward the recommendations for improvement.
