主要运用规范分析的方法，研究羼家及其土地管理权的行使对农村土地产权制度的影响。基本结论是：国家对农村土地实行管理是必要的，因而农地产权或多或少都会受到其影响。我国的问题在于政府对农地产权的管理方式既不规范，也不适应市场经济的要求，使农地产权残缺不全，不利子其经济效益的发挥和维护农民的权益。解决该问题的基本思路是通过改革。在规范政府行为的基础上，构建与市场经济体制相适应的农村±地产权制度及其运行机制。

This paper studies the impact of tile governmental role and its land management rights over the rural land property rights system with normative analysis. The basic conclusion identifies necessity of the governmental role in rural land management but meanwhile more or less will affect the agricultural land property rights. The problem in China lies in that the governmental management over the agricultural land property rights is neither standardized, nor does it meet the demand of market economy. The incompleteness in agricultural land property rights brings neither benefit to the full play of the economic efficiency, nor safeguards the interests of farmers. The crucial solution to this problem is to reform and, on the basis of norms of government action, build a rural land property rights system suitable to the market economy system and its operational mechanism.
