世界信评机构的发展一直以来主要依靠自律,法律监管等外部约束非常微弱。为信评机构自律发展提供最佳激励的就是以信誉资本积累为核心的信誉机制。但是,在全球金融危机之中信誉机制失去功效,这也使各国信评机构的法律改革出现是恢复信誉机制以延续自律还是推翻信誉机制施以严格监管的广泛争议。审视我国信评机构的现状及地位,为培育和规范国内的信评机构,实现从自律到他律,逐步构建我国严格的信评机构监管法律制度。

The development of credit rating agencies depends on the self-regulation,the optimal motivation to which is the reputation mechanism.However,the mechanism ceases to be effective in the global financial crisis.How can people access to the law reform of the credit rating agencies at the post-crisis era？ One approach is to resume the reputation mechanism for the self-regulation dominating the other is to overthrow the reputation system for the governmental supervision dominating.In accordance to the status quo of China＇s credit rating agencies,the approach of the law reform should be from self-discipline to other-control.It is necessary for developing the credit rating agencies to construct the rigorous governmental supervision dominating system.
