我国商业秘密保护的法律体系虽已初步形成,但涉及多部法律,整体而言,还存在法律体系分散不统一,相关法条和具体规定有待系统化、规范化,对商业秘密权利人的保护有待加强,对商业秘密侵权行为打击惩罚力度不够等不足。因此,必须尽快完善我国现有的商业秘密法律保护体系,在借鉴国外立法先进经验的基础上,构建一套全面的商业秘密保护法律制度体系,使商业秘密在我国得到充分有效的保护。
我國商業祕密保護的法律體繫雖已初步形成,但涉及多部法律,整體而言,還存在法律體繫分散不統一,相關法條和具體規定有待繫統化、規範化,對商業祕密權利人的保護有待加彊,對商業祕密侵權行為打擊懲罰力度不夠等不足。因此,必鬚儘快完善我國現有的商業祕密法律保護體繫,在藉鑒國外立法先進經驗的基礎上,構建一套全麵的商業祕密保護法律製度體繫,使商業祕密在我國得到充分有效的保護。
아국상업비밀보호적법률체계수이초보형성,단섭급다부법률,정체이언,환존재법률체계분산불통일,상관법조화구체규정유대계통화、규범화,대상업비밀권리인적보호유대가강,대상업비밀침권행위타격징벌력도불구등불족。인차,필수진쾌완선아국현유적상업비밀법률보호체계,재차감국외입법선진경험적기출상,구건일투전면적상업비밀보호법률제도체계,사상업비밀재아국득도충분유효적보호。
Although Chinese legal system of trade secret protection has been formed, but it involves too many branches. Overall, there are still exists the following deficiencies that bring bad effects to the protection of trade secret： the protection legal system for trade secret is too dispersed, related provisions and specific regulations need to be systematized and standardized, the protection strength of trade secret rights is still insufficient, and the punishment against infringement of trade secret is inadequate. Therefore, it is necessary to perfect our existing protection system of trade secrets, and build a new set of trade secret protection system based on advanced experience of foreign legislation, and bring adequate and effective protection to trade secrets in China.
