法律翻译虽然极具严谨性和规范性，但是也离不开译者的主动性和创造性。从认知语用学的关联理论出发，探讨了法律翻译需要创造性的理论依据和现实依据，并且运用关联理论的最佳关联原则作为法律翻译中发挥创造性的指南，提出了归化法和异化法两种创造性翻译策略。法律翻译的创造性作为一种手段可以再现原文的最佳关联，达到对原文更高层次的忠实。

Although preciseness and normalization are the typical characteristics of legal translation, creativity is essential to legal translation. From the perspective of Relevance Theory in cognitive pragmaties, this article explores the theoretical and realistic basis for creativity in legal translation, pointing out that the optimal relevance principle of Relevance Theory can be used as guidelines for creativity in legal translation and ＇that domestication and foreignization can be adopted as creative translation strategies. Creativity in legal translation can be an effective means to reproduce the optimal relevance of the original, hence achieving a higher level of ＂fidelity＂.
