我国颁布了首个反垄断司法解释,这将对反垄断民事诉讼案件的审理起到积极的指导作用。反垄断民事诉讼作为反垄断法实施的重要途径之一,其自身的繁荣将会推动我国反垄断法实施进入一个新的发展阶段。然而,我国反垄断法领域尚未形成垄断民事责任构成要件理论,这不利于垄断民事责任的认定及其范围的确定。借鉴刑法、侵权法等部门法理论,结合反垄断法自身的特点,我国垄断民事责任可以包括四个构成要件,即不属于豁免或适用除外的情形、垄断行为、垄断损害以及因果关系。这可以为我国反垄断民事诉讼案件的处理提供较好的分析框架,并借助于实践中的垄断案件的处理而不断得到完善,成熟。

The first Anti-monopoly Judicial Interpretation which China has just promulgated will play an active role in guiding the anti-monopoly civil actions, As one of the most important implementation ways of the anti-monopoly law, the anti-monopoly civil action＇s prosperity will promote the enforcement of China＇s anti-monopoly law into a new development stage. However, the theory of the constitutions of the monopoly civil liability has not yet formed, which is not conducive to the determination of the monopoly civil liability. By learning from the criminal and tort law theory, and combining with the anti-monopoly law~ own characteristics, the constitutions of monopoly civil liability may include four elements, namely not belonging to the exemption or exception areas, monopolistic behavior, monopolistic damage, causation. This theory can provide us a good analytical framework for the handling of the anti-monopoly civil cases, and through this process, the theory itself will get perfected and matured.
