在我国现行立法中,有3部法律与8部行政法规直接使用了社会管理概念。这些立法中的社会管理概念,有不同的来源、表现形式、语境、内涵、外延,形成了不同类型。无论立法内外,社会管理概念都不同于治安管理概念。在社会管理创新过程中,切忌以治安管理主导社会管理。社会管理创新语境中的社会管理概念与现有立法中的社会管理概念联系密切,同时存在一定的张力。因此,完善社会管理立法刻不容缓。要认真对待现有立法中的社会管理概念,这是完善社会管理立法躲不开、绕不过的一个课题。

In our current legislation,there are three statutes and eight administrational regulations using the term ＂social administration＂ explicitly.This term has different sources,exists in different forms,in different context,has different meaning and extension,forms different types.Whether in these norms or not,the social administration is different from police administration.In the course of social administration innovation,we must not use the police administration to dominate the social administration.The term ＂social administration＂ in context of social administration innovation is closely related to this term in our current legislation,but there still exists some intension between them.So it is very urgent to promote the legislation of social administration.We must take this term seriously.It is an important task we should face and we can＇t stay away in the course of completing the legislation of social administration.
