我国在新《刑事诉讼法》修改前并没有对诱惑侦查进行法律定位,尽管其在实践中已被侦查机关所运用,但出现的问题颇多。为减少诱惑侦查在实践中的负面效应,此次新修订的《刑事诉讼法》明确规定了诱惑侦查,然而新法中规定的诱惑侦查颇为原则化,对诱惑侦查的实施主体、适用范围、原则及合法性应明确予以规定。
아국재신《형사소송법》수개전병몰유대유혹정사진행법률정위,진관기재실천중이피정사궤관소운용,단출현적문제파다。위감소유혹정사재실천중적부면효응,차차신수정적《형사소송법》명학규정료유혹정사,연이신법중규정적유혹정사파위원칙화,대유혹정사적실시주체、괄용범위、원칙급합법성응명학여이규정。
As a special investigation method,temptation investigation has been legislated and regulated by foreigner countries and has been applied to judicial practice in our country,yet it has negative effect on solving the complicated cases.In order to reduce the negative effect,the new revision of the ＂criminal procedural law＂ clearly defines the temptation investigation,but no definite regulation are made on its implementing subject,its scope,its principles and legitimacy.However,this new establishment system reflects the progress of legal system in our country.
