构建我国商业银行破产重整法律制度最重要的现实意义，在于让银行业的经营乃至退出真正市场化。综合考虑我国现行破产法律制度及我国传统的立法、司法实践，我国商业银行破产重整制度比较适合采取折衷立法模式。其基本原则应包括稳定优先、公开透明、最低成本、快速处置、权益均衡五个方面。此外，还应该特别注意破产重整程序的启动标准、申请主体以及程序运行中的公权力主导问题。

The most important practical implication to build China＇ s legal system for commercio1 banks＇ bankruptcy reorganization is to make the operation and even exit of banks totally market-oriented. Regarding China＇ s actual situation, bankruptcy and restructuring of commercial banks should adopt the compromising legislative pattern, and its basic principle should include： priority of stability, transparency, lowest cost, quick disposal, and balanced rights and interests. In addi- tion, special attention shall be paid to the starting standards, applying organization, and the leading role of the public au- thority in the bankruptcy reorganization process.
