宪法只约束公民与国家之间的公法关系，不干涉公民与公民之间的私法关系，是西方法律的一个深远的历史传统。但二十世纪后期，随着社会和法律的发展，在西方社会的司法实践中又产生了一个有悖上述传统的相同趋势，即宪法权利规范对公民与公民之间的私人关系或私法关系的渗透和影响。德国与美国是产生这一趋势的两个典型国家，分别生成了使这种趋势正当化的两个典型理论，即“价值辐射”理论和“国家行为”理论。由这两个不同理论所指导的司法实践能够产生不同的法律后果。

The Constitution onl state, but not private relations y restrains the public between citizens. This law relationship between is a historical tradition in the citizens and the western laws. But in the later part of the twentieth century, along with the development of the society and law, there ap- pears a common trend different from the tradition in the juridical practice, that is, the permeation and influence of the Constitution on the private relations between citizens and the private laws. Ger- many and America are the two typical countries of this trend and that leads to the emergence of the two typical theories, namely, ＂value radiation＂ theory and ＂state behavior＂ theory. These two theo- ries can lead to different legal results in judicial practice.
