体育运动中的合理冲撞是以体育规则和体育道德为界限的体育正当行为,它具有一定的项目特征。合理冲撞正当化的法理基础是行业自治性和社会相当性理论,它具有非犯罪性和非侵权违法性,法律应该根据它正当化成立的条件对其进行扰让。在纠纷的解决中,应该利用以保险为主,以体育内部解决、法院解决、社会调节和社会保障制度等方式为辅的解决模式来解决纠纷。
