In the United States ,because of the separation of the executive,legislative and judicial powers system,the Supreme Court has unique function on the formulation of American educational policies ,especially after World War II,according to the hearing of the cases that involve school teachers and students＇ constitutional rights,The U.S.Supreme Court has overcome the inertia of the long history of ＂negative managing education by law＇and promoted the prositive development of American education.
