法律是一种不断解释性概念，法律解释是法律适用的前提。作为法官释法的两种不同的司法《学，司法克制抑或司法能动的分歧集中于法官行使自由裁量权的限度。近年来，司法能动备受学者书崇，但也常被误读或曲解；实践中深受法官青睐，却多为之所滥用，甚至被异化为掠夺和扩张法律解释术的武器。当务之急，法官应当奉行司法克制，尊重并认真对待规则，依据法律文本的含义解释法律，审慎地建构裁判规范。

Law is a kind of concept which needs to be interpreted ceaselessly, and application of law should be on the premise of interpretation of law. Judicial restraint or judicial activism impersonates derives from two distinct judicial philosophy of the interpreter of law, of which the focus of divergence of the two lies in the confine and limit of discretionary power which judge could perform. In recent years the scholars praised highly of judicial activism, but frequently misreading its meaning. In practice, judicial activism is in judge＇ s good graces and they have almost unlimited butout-of-order interpretation of law. It is pressing that the judge should pursue .judicial restraint and interpret the law strictly in conformity to the rule and then construct the adjudication rule in a conservative manner.
