现代法律多元论是＂法的社会科学研究＂反叛传统西方法学的产物,同时也是各领域学者对法律现代性反思的结果,它经过近百年的发展,至今已形成颇具影响力的一套话语。晚近法律多元论繁荣发展的背后暗藏着三重困境：即＂整合＂、＂定位＂以及＂划界＂问题。此三重困境来源于＂法学＂和＂社会学科＂两种主导研究路径之间的彼此割裂,限制着法律多元论在理论和实践上的潜力,而由此产生的诸问题仍未得到充分重视和讨论。

Modem legal pluralism is the result of the process of social scientific studies of law against traditional west- ern legal tradition, meanwhile it is also the result of scholarb reflection of legal modernity. Nowadays legal pluralism has formed powerful discourse in the past century, but there are three folded dilemmas behind its prosperous victory,i, e. , inte- gration, location and position, which are the consequences of the rapture of two predominant research routes, legal and so- cial scientific, and confines the latent force of the theoretical and practical potential of legal pluralism, thus concerning is- sues are not being taken seriously.
