劳务派遣制度自实施以来,出现了大量问题,劳务派遣用工泛滥、不规范,劳动者的合法权益得不到有效保障,同工不同酬问题较为突出,派遣协议双方存在用工隐患,严重影响劳动关系的和谐与稳定。因此,应当对劳务派遣作进一步规制。本文针对《中华人民共和国劳动合同法修正案（草案）》（以下简称劳动合同法修正案草案）拟定之劳务派遣修改,提出若干学理建议。
勞務派遣製度自實施以來,齣現瞭大量問題,勞務派遣用工汎濫、不規範,勞動者的閤法權益得不到有效保障,同工不同酬問題較為突齣,派遣協議雙方存在用工隱患,嚴重影響勞動關繫的和諧與穩定。因此,應噹對勞務派遣作進一步規製。本文針對《中華人民共和國勞動閤同法脩正案（草案）》（以下簡稱勞動閤同法脩正案草案）擬定之勞務派遣脩改,提齣若榦學理建議。
노무파견제도자실시이래,출현료대량문제,노무파견용공범람、불규범,노동자적합법권익득불도유효보장,동공불동수문제교위돌출,파견협의쌍방존재용공은환,엄중영향노동관계적화해여은정。인차,응당대노무파견작진일보규제。본문침대《중화인민공화국노동합동법수정안（초안）》（이하간칭노동합동법수정안초안）의정지노무파견수개,제출약간학리건의。
Since the implementation of Labor dispatch system, there are a lot of problems , such as la- bor dispatch flood and is not standardized, the legitimate rights and interests of workers can not be effectively guaranteed, rights of participating in democratic management of enterprises and trade union can not be implemented, equal pay for pact on the harmony and stabili unequal work is more prominent and so on. All of these have a serious ty of labor relations. Therefore, we should further regulation on labor lm dis patch. According to ＂ People＇s Republic of China Labor Contract Law Amendment （Draft） ＂（Hereinafter is referred to as the labor contract law draft）, which is ready to make some modification, the author puts forward some theoretical suggestions.
