非物质文化遗产法律保护的意义在于借由小传统的维系，确保大传统的文化认同。这种意义决定了“非遗”的法律保护应当以公法保护为主导，并在区分文化商品与文化公共品、文化的表达与文化的“文法”的基础上，侧重于文化公共品的提供和文化“文法”的保护。这种保护方式和对象的特定性又决定了政府主导的“非遗”保护应有适当限度，尊重“非遗”的文化本位性。我国“非遗”地方保护制度尚未提升至《非物质文化遗产法》的思想高度，在保护实践上还存在忽视民间文化小传统形成的规律性、挟制民间文化认同的弊病，在一定程度上扭曲了文化认同的形成，应在尊重“非遗”规律性的基础上。调整公法保护机制。

The purpose of legal protection for intangible cultural heritage is to ensure cultural identity of macro-tradition on the basis of maintaining micro-tradition. This determines the dominant role of public legal protection in this field, and emphasizes supply of cultural public products and protection for cultural ＂grammar＂ in distinguishing cultural commodities from cultural public products as well as culture expressions from cultural ＂grammar＂. Also, this protection and the objects under the protection require the government to conduct the protection with limit and respect cultural-oriented nature of intangible cultural heritage. The system of local legal protection for intangible cultural heritage in China has not reached the level stipulated in Intangible Cultural Heritage Law. In protection practice, the law of micro- tradition is ignored and the folk cultural identity is hindered, which have distorted the formation of cultural identity. Therefore, legal protection mechanism should be adjusted based on the respect for the law of intangible cultural heritage.
