为了加强对管制、缓刑犯的监管，《刑法修正案（八）》规定了禁止令制度，成为刑法个别化道路上的一次重要实践，也符合宽严相济刑事政策的要求。禁止令的生命在于实施，为了保障禁止令的实施效果，各地司法行政机关做了有益的探索，成效显著。但禁止令的实施也存在着适用总量少、案件类型狭窄、质量不高；执行机制不完善、监督不彻底、配合不到位等问题，需要通过完善相关立法、提高司法适用水平、健全社区矫正机制、强化执行监督与配合来解决。

위료가강대관제、완형범적감관，《형법수정안（팔）》규정료금지령제도，성위형법개별화도로상적일차중요실천，야부합관엄상제형사정책적요구。금지령적생명재우실시，위료보장금지령적실시효과，각지사법행정궤관주료유익적탐색，성효현저。단금지령적실시야존재착괄용총량소、안건류형협착、질량불고；집행궤제불완선、감독불철저、배합불도위등문제，수요통과완선상관입법、제고사법괄용수평、건전사구교정궤제、강화집행감독여배합래해결。
In order to strengthen the supervision of public-controlled criminal offenders and proba- tion, the Eighth Amendment to the Criminal Law establishes the injunction system. It is an impor- tant practice of the individual criminal law, also in line with the requirements of the criminal policy of the temper criminal policy with mercy. The effectiveness of the injunction lies in its implementation. In order to ensure its implementation effect, the judicial administrative organs involved have done much and obtained remarkable results. The implementation of the injunction has faced the following problems： very few cases and types in application, poor quality, imperfect execution mechanism, in- complete supervision, and poor coordination. The solutions lie in the perfection of the relevant legisla- tion, the improvement of the judicial application and the community correction mechanism, as well as the enhancement of the supervision and coordination.
