随着经济的快速发展,我国电子商务发展迅速,各类民营快递公司也应运而生,但快递服务过程中出现了一系列的法律问题,引发了一系列的纠纷和矛盾,对我国物流快递业发展造成了严重的负面影响。与国营邮政企业性质不同,民营快递企业根据我国企业法设立,不受《邮政法》调整,应适用我国民事法律规定,具体受我国《合同法》调整。民营快递企业快递合同的格式条款应根据《合同法》的相关规定来制定,并根据《合同法》来分析它的效力。鉴于快递服务合同双方作为一般民事主体,法律地位相等,应适用《民法通则》、《合同法》等相关法律关于市场交易主体双方权利和义务的规定,如果快递企业违约,没有将邮件安全送达目的地,应按照邮件实际价值进行赔偿。

With the rapid development of China＇s economy,the E-business has been developed rapidly and there are so many private express companies emerging in response to the proper time and conditions.But there are some legal problems with that,which have the negative impact on the development of China＇s logistic express industry development.Comparing to the state-run postal enterprises,private express enterprises are established according to the Company Law,and are not regulated by the Postal Law;the application law of the private express companies is the Contract Law.Because the parties of express contract are civil subjects with the same legal position,they should be regulated by the regulations concerning the rights and obligations of market transaction participants in the General Principles of the Civil Law,the Contract Law and other related laws.
