分析专利权对企业经营的意义以及其在中国发展所面临的问题，并对中国企业专利权“护城河”作用面临的主要风险进行了讨论。不能盲目崇拜国外发展模式中“护城河”的概念，否则将容易误导中国中小企业的经营和发展。在目前中国知识产权保护的框架之内，拥有专利权的企业面临的挑战依旧十分巨大。
分析專利權對企業經營的意義以及其在中國髮展所麵臨的問題，併對中國企業專利權“護城河”作用麵臨的主要風險進行瞭討論。不能盲目崇拜國外髮展模式中“護城河”的概唸，否則將容易誤導中國中小企業的經營和髮展。在目前中國知識產權保護的框架之內，擁有專利權的企業麵臨的挑戰依舊十分巨大。

How much patents contribute to the performance and the value of a business in China depends hugely on characteristics of China. Economic moat, named by Warren Buffet, is not as powerful as in the West in business operations and in market competitions for Chinese small and medium - size firms. Overestimation in patent defen- ding power for patent holders is dangerous and misleading under domestic intellectual property right protection framework in China. This paper is to illustrate the meaning of patents to Chinese firms and to show issues in patent development in China. It also analyzes the risk of treating patents as economic moat.
