是与应该、描述与规定之间的连接和过渡问题是道德哲学与伦理规范基础研究的根本问题，也是迄今为止最为棘手的难题之一。塞尔试图通过制度性事实理论解决这一问题，但他获得的只是构成性或制度性的应该，对于伦理规范这样的制度性事实，需要的是对于其“应该性”的“证成”。

The connection and transition between ＂is＂ and ＂ought＂, ＂descriptive＂ and ＂prescriptive＂ are the basic problems for the fundamental research of moral philosophy and ethical norms, and also one of the most difficult problems so far. John R. Searle attempts to resolve the problem by the theory of institution- al facts~ however, he obtained merely constitutive and institutional ＂ought＂. For such institutional fact as ethical norms, the ＂justification＂ for their ＂oughtness＂ is needed.
