从文化的结构来看,清末以来中国从传统法制向现代法制的历史性跃进是一个从文化的物质层面——制度层面——精神层面逐步递进、逐步深化的过程。而国人对中国现代化的认识与实践,从粉碎＂四人帮＂到20世纪90年代后期的近30年间,在近代以来的＂大圆圈＂上,又产生了一个＂小圆圈＂。社会主义法治理念的提出,标志着我国的法制现代化建设深入到法律文化的核心层面——观念（理念）层面,并使之从法制向法治转变。中国当下法治实践最大的问题,在于法治与法治理念并没有成为全社会的共识。因此,培植和建设社会主义法治文化,并使之在全社会形成共识,是建设社会主义法治国家的思想观念基础。

Since Late Qing dynasty,China has evolved from traditional ruling by law to modern ruling of law.From the perspective of cultural structure,it is a process from physical to institutional and continuingly to spiritual level developing gradually and improvingly.As to China＇s modernization and the practice thereof,the domestic viewpoint holds that a particular small ＂circle＂formed,which refers to the recent 30 years from the downfall of＂Gang of Four＂to 1990s,within the big＂circle＂of the whole modern history.The proposed socialism ruling of law reveals that the modernization of law has evolved up to the core of legal cultures,namely the conceptual level,thus the ruling by law is transformed to ruling of law.The biggest issue in current ruling of law is that the common sense of ruling of law and its conception has not yet formed in the whole society.Therefore,the culture of socialism ruling of law should be cultivated and established to form a common sense within the entire society,which is the conceptual foundation for constructing the nation of socialism ruling of law.
