分析了代建制在实践操作过程中存在的不足，揭示了制约代建制发展的因素：代建人法律地位的缺失、代建费过低、代建项目范围的设定不舍理等，并就代建制的完善提出了明确代建人的主体资格、合理设定代建人收益标准、完善招标制度、严格规范代建人的行为等建议，以推动代建制度的El益法治化。

This paper analyzes the deficiencies of agent construction system in practical operations, and reveals the factors restricting the development of agent construction system including lack of the l.egal status for agents, low agent construction costs and unreasonable construction project scopes. It also proposes some measures to improve the system by defining agents＇ qualifications, completing the cost and bidding system, and strictly normalizing agents＇ behaviors as to promote the legalization of agent construction system.
