当下中关补贴与反补贴摩擦在向新能源产业领域蔓延，突出表现为美国对华新能源产业实施“双轨制反补贴”战略。美国一方面对华风能产业补贴措施提起WTO诉讼，在WTO争端解决机制下指控中国的禁止性补贴，另一方面对华太阳能光伏和风能产品发起“双反”调查，指控中国的可诉性补贴，双管齐下，旨在打压中国战略性新兴产业（新能源产业）国际化发展空间。中关经济同步转型及美国强化对华贸易执法战略等因素促使美国对华新能源产业实施“双轨制反补贴”战略。为了应对未来美国不断强化实施这种战略，中国应当坚持攻防兼备的原则，遵循“国内主动限权、WTO限权和扩权、对美积极应诉、对美诉讼和反制”的基本思路，采取合理有效的策略加以应对。

The friction between China and the U.S. over the issue of subsidy and anti-subsidy is spreading towards the new energy industry, currently culminat-ing in the U.S. strategy of applying bipartite system of countervailing against Chi-na＇ s new energy industry. The U.S. filed WTO litigations against China＇ s wind industry subsidies measures while simultaneously launching investigations against China＇ s solar photovoltaic ＆ wind energy products based on the bipar-tite system of countervailing, charging against China＇ s actionable subsidies. Both worked to contain the potential development of China＇ s strategic emerging indus-tries （new energy industries） in the international market. The synchronous econom-ic transformation of China and the U.S., together with the U.S. reinforcement strategy of trade law against China, are considered to contribute to the U.S. strat-egy of bipartite system of countervailing against China＇ s new energy industry. To reply to the escalating challenge from the U.S., China should make reason-ably aggressive and strategic moves in its defensive efforts, in the light of such fundamental ideas as ＂actively limiting power at home, limiting ＆ expanding power at WTO, proactively responding to U.S. litigations, and taking countermea- sures against the U.S.＂
