我国城乡规划法治的现在时态是农村向城市“倾斜”、社会向政府“倾斜”的形式主义法治。正是基于此，我国城乡规划法的现实运行面临的是利益的失衡与执行的困境。笔者主张城乡规划不仅要遵守法律的形式约束力，而且必须具有实质的正当性，其中的关键就是要消解城市与农村、政府与社会、法的应然性与实证性之间的紧张与冲突关系。中国城乡规划法治的未来期待是：保证城乡规划的区域利益中立，实现城乡规划的信息公开，落实城乡规划的权责对等的、“平衡”的实质主义法治。

The status quo of the rule of law in China＇s urban and rural planning is the formalism in the rule of law, with the rural area tilting to the urban area and the society tilting to the government. Based on this, there is imbalance of interests and the plight of implementation what the practical operation of China＇s ur- ban and rural planning law facing is the. This article argues that urban and rural planning should not only comply with the law in the form of binding but also must have substantial legitimacy, of which the key is to de- fuse the tension and conflict between the urban and rural areas, government and society, the law＇ s inevitabili- ty and positivitat. The future expectations of the rule of law in China＇s urban and rural planning is to ensure the neutralization of regional interests in the urban and rural planning, realize urban and rural planning infor- mation disclosure, and implement substantially the rule of law in the urban and rural planning with the balance and the equality of rights and responsibilities.
