马克思主义法律思想中国化，有实践主导与文化扬弃两个层面的路径，而实践主导层面则是根本的。延安时期，在马克思主义法律思想中国化的过程中，实践主导层面表现为：通过指导思想教育，坚持以毛泽东思想为指导，批判“左倾”做法，确立正确的工作原则；通过典型案例教育，确立法律面前人人平等的法制原则；通过服务中心教育，注重紧密结合革命纪律性教育，服务并服从于抗日战争的中心工作。文化扬弃层面表现为：通过文化反思教育，摒弃了以往“唯成分论”与“唯功绩论”等错误思想；通过重点对象教育，强调党员干部是重点对象，要求党组织和党员成为服从法律的模范。

Culture sublating is revealed as sublating the wrong idea of ＂the paramount importance of class origin＂ and ＂the paramount importance of merits and achievements＂ through education of cultural retrospection. With the education of key object, it is emphasized that party members and cadres are the key objects and the party organization and members are required to be the models who obey law.
