我国社会目前存在比较严重的诚信危机，突出地表现在救助他人的问题上。借鉴国外好撒马利亚人法的立法和司法经验，在我国确立好撒马利亚人法的基本原则，不对公民科加一般救助义务，仅确认特殊救助义务，坚持对见义勇为者和善意施救者的损害予以救济，通过善意施救者的抽象过失和具体过失豁免权以保护善意施救者，鼓励公民积极救助他人；辅以故意和重大过失造成损害的承担侵权责任，促使救助行为达成其救助目的，在切实保护救助者的同时能有效地规范救助行为。
