“卷宗移送主义”“复印件主义”“起诉书一本主义”各有利弊，我国2012年刑事诉讼法修订重新选择“卷宗移送主义”，这不是历史的倒退。三种卷宗移送方式是并列关系，而非递进关系，法官庭前阅卷与法官预断并无必然关联。当下的中国，选择“卷宗移送主义”不是对理想的妥协，而是对现实和法律文化传统的尊重，具有理论上和实践上的正当性。
“捲宗移送主義”“複印件主義”“起訴書一本主義”各有利弊，我國2012年刑事訴訟法脩訂重新選擇“捲宗移送主義”，這不是歷史的倒退。三種捲宗移送方式是併列關繫，而非遞進關繫，法官庭前閱捲與法官預斷併無必然關聯。噹下的中國，選擇“捲宗移送主義”不是對理想的妥協，而是對現實和法律文化傳統的尊重，具有理論上和實踐上的正噹性。

There are both pros and cons of Doctrines of Deportation of Files, Photocopyism and Indictment - only Doctrine. The 2012 Amendment of Criminal Procedural Law once again in favour of the Doctrine of Deportation of Files cannot be regarded as the retrogression of history. The above - mentioned three approaches of deliver of dossi- er shall be considered as parallel instead of progressive, and reading files before trial will not definitely lead to judge＇ s prejudice. Considering China＇ s reality, the choice of Doctrine of Deportation of Files is justified both theo- retically and practically, which is respect to reality and legal and cultural tradition, rather than compromise of ide- al.
