在2001年Auld勋爵《对英格兰和威尔士刑事法院的评论》、2002年刑事司法白皮书《所有人的正义》以及英国法律委员会近年的相关报告的指引下，十年来英国相继颁行《2003年刑事审判法》、《2012年刑事诉讼规则》及其他相关刑事法规。随着司法改革的推进，英国刑事证据制度出现了令人瞩目的变化：首先，重新平衡被告人和被害人证人之间的关系，更多地向被害人和证人倾斜，允许在庭审中将针对被告人被控罪名的相关不良品格呈交陪审团；其次，更加依赖庭审法官的自由裁量权以及法官对陪审团的指示；再次，允许陪审团更多地接触证据，运用常理决定证据的价值；最后，注重保护证人尤其是被害人证人的作证积极性。

After the launch of ＂Justice for All＂ campaign in 2002 and the publication of ＂A Review of the Criminal Courts of England and Wales 2001 ＂from Lord Auld, with the promotion of the reports from Law Commission, Criminal Justice Act 2003, the Criminal Procedure Rules 2012 were published in succession. Under the moving force of criminal procedural justice reform, the criminal evidence rules in the United Kingdom reveal new trends：first of all, it promotes the aim of ＂rebalaneing＂ the criminal justice system away from defendants to move favorable treatment for victims and witnesses, allowing greater admissibility of evidence of a defendant＇ s previous convictions and other misconduct where this is relevant to an issue in the ease ; second, the reforms adopt a strategy which involves a greatly increased reliance on discretion on the part of trial judges in admitting evidence and directing juries about it;third, fact finders are given more opportunity for hearing evidence and more scope for exercising common sense in evaluating it;fourth, it provides greater protection of the interests of witnesses, particularly witnesses who are victims of crime.
