台湾土地开发许可制由“容积移转”运作机制与“增量利益公共回馈”分配机制构成.台湾地政机构分别在地狭人稠的都会区与环生系统脆弱的农业区以及两区域间主导实施土地开发许可制,旨在达到发展经济与保育农地的双重目的,实践中取得良好效果.在性质上,开发许可制介于土地用途分区管制制度与土地发展权制度之间,是一种准市场化运作的土地开发与管理制度.大陆地区在构建土地发展权制度与配置土地发展权过程中,可借鉴台湾土地开发许可制,在将土地发展权国有化基础上,完善其在政府、土地原权利人与社会公众之间的合理分配比例.
檯灣土地開髮許可製由“容積移轉”運作機製與“增量利益公共迴饋”分配機製構成.檯灣地政機構分彆在地狹人稠的都會區與環生繫統脆弱的農業區以及兩區域間主導實施土地開髮許可製,旨在達到髮展經濟與保育農地的雙重目的,實踐中取得良好效果.在性質上,開髮許可製介于土地用途分區管製製度與土地髮展權製度之間,是一種準市場化運作的土地開髮與管理製度.大陸地區在構建土地髮展權製度與配置土地髮展權過程中,可藉鑒檯灣土地開髮許可製,在將土地髮展權國有化基礎上,完善其在政府、土地原權利人與社會公衆之間的閤理分配比例.

Land development permit system consists of the operation mechanism of floor area ratio transfer and the distributive mechanism of incremental interest feedback. In densely-populated metropolitan areas with little land and in rural areas with fragile ecosystem or in areas between the two, land management authorities in Taiwan carries out the system of land development permit, meanting to achieve the dual purposes of economic development and farm land conservation, which actually has achieved desirable results. In nature, the system of development permit, falling between land control system and land development system, is a quasi-market-oriented land development and management system. Mainland China may learn from Taiwan, and, on the basis of nationalized land development right, improve the reasonable distribution of incremental interest among the government, the land owner and the public.
