注册商标权续展制度很有意义,但因我国法律规定不够明确,致使宽展期内注册商标权的保护遭遇许多困惑,学界认识分歧较大,原因在于对宽展期内注册商标权的定性认识很不统一。对此,建议我国商标法第三次修改中加以明确,可采＂效力待定说＂,并有两种方案可供选择：（一）保留宽展期制度,明确和细化宽展期内的商标权保护;（二）取消宽展期制度,延长注册商标权的有效期,并在有效期内确定更长的续展期。

The system of trademark rights renewal is very significant, but as the laws on it in our country aren＇t explicit, the aegis of trademark rights has met much bewilderment during the grace period. What＇ s more, many differences have occurred in the academic field. The reason is that the recognition of the trademark rights＇properties is quite skimble -scamble. Thus, the trademark rights＇properties should be described specifically during the trademark law＇s third revision, also, there are two solutions can be chosen. （一） Reserve the system of grace period, make the aegis of trademark rights clear and particular during the grace period; （二.） Abolish the system of grace period, prolong the trademark rights＇expiry date, and establish longer renewal period during the valid period.
