治安维护是警察最重要的职能之一。德国警察主体法律已形成统一的体系,有利于治安维护和公民权保护功能的实现。在治安职能方面,联邦警察与各邦警察职能划分明确;各邦警察作为治安维护的主体还有更为细致的权限划分。德国警察主体法律体系充分遵循基本法要求和公法中的比例原则。我国警察法律体系尚有较大的完善空间。人民武装警察部队与公安机关作为国内治安维护的主体,二者职能权限的划分、公安机关内部行使治安职能的警察与其他警察主体的职能划分可在与德国警察法相似的层面上学习和借鉴以完善我国的警察主体法律体系。

Controlling public order is one of the most important functions of police system. Germany police law system is unified and unambiguous, which is benefit for protecting the public order and rights of citizens. In the aspect of controlling public order, not only the functions of federal police and states police, but also the functions of different departments in states police system are all clear and definite. The police law system of Germany respects its constitution, conforms the principle of proportionality. Chinese police law system still has huge space to perfecting up to now. How to separating the functions and powers between the People ＂s Armed Police and public security bureaus, between different departments of the public security bureaus, we can get inspirited from the Germany oolice law system.
