虽然在不同时期、不同语境下公平有着不同的内涵,但对公平的追求是人类社会一个亘古不变的主题。民法中的公平原则,不同于伦理学中与正义可替换的公平,它着力谋求民事主体之间利益关系的均衡,在交易领域,更侧重于对民事主体间非自愿的利益失衡进行结果上的矫正。在这种意义上,公平原则以平等原则为前提,属于意思自治原则必不可少的补充。

We,the human beings,have always been loyal to the pursuit of fairness in spite of the variation of its meaning from time to time,from context to context.In the context of ethics,the notion of fairness is exchangeable with the Abstract concept of justice,whereas in the circumstance of civil law,the principle of fairness has concrete connotation.Specifically,it means reasonable balances among various individual interests in civil society.In the province of individual transactions,the principle of fairness emphasizes the correction of interest imbalances that severely go against certain individuals’ expectations of transactions.In relationship,the principle of fairness is grounded on the principle of equality that means treating the like alike,and constitutes a necessary supplementary to the principle of autonomy in the context of individual transactions.
