国际经济秩序的构建有赖于国际软法与硬法的共同作用。研究国际经济秩序构建有必要分析国际软法与硬法的互动关系。国际软法与硬法的互动取决于国际合作方的权力、相互间的利益分配、国际机制的复杂性和执行困境等因素,表现出更替、互补和冲突三种关系。我国应根据不同的具体情况,善于利用国际硬法和软法的不同相互作用,在＂成本最低＂的基础上实现我国的和平发展战略,构建国际经济新秩序。

Construction of the international economic order depends on the interaction of international hard law and soft law. It is necessary to analyze the interactive relationship between the international soft law and hard law for studying the construction of the international economic order. The interaction between international hard law and soft law is determined by the power of the international cooperators, the distribution of the interactive benefit and the complex and difficulty of the international organizations in practice, which shows the three relations of replacing, complementing each other and conflict- ing. Our country should realize our peaceful development strategy and construct a mew international economic order on the basis of ＂the lowest cost＂ by using the different interactions of international hard law and soft law according to the concrete conditions.
