关于社区矫正的法律属性,主流观点是将其看作与监禁矫正相对应的一种行刑方式。然而,笔者认为,依这种观点构建中国的社区矫正制度存在诸多弊端。社区矫正不属于刑罚执行方式,不宜纳入刑罚体系,它应当是现有刑罚执行制度以外的一种全新的犯罪预防模式。社区矫正与刑罚执行有着本质的不同。社区矫正的主体是社区,不必拥有刑罚执行权,其实施的内容是矫正,不是惩罚,其矫正的对象也不仅限于罪犯。社区矫正与现有刑罚执行制度没有冲突和矛盾,不用对既有法律作大的修改。

The legal attribute of communitg correction is usually considereu an execuuw way and the other way is imprisonment. This paper thinks this opinion is wrong. Community correction does not belong to punishment, improper to be into the penalty system, and should be a completely new criminal prevention and control mode. The subject of community correction is community whose content is to correct not pun-ishment and its object of correction goes beyond criminals. In fact there is no great contradiction and con-flict between community correction and punishment, so it only needs a little amendment.
