法国自20世纪60年代开始推行地方试验，同时由最高行政法院对其进行司法审查，以化解地方试验对国g＇：-}Vl统一的冲击，并保证试验措施充分发挥试验效用。尤其是2003年修宪进一步将地方试验宪法化，其实践折射出须以法律调控对地方试验“去弊扬利”，使地方试验制度具有明确的目标、限定的期限、科学的效果评估以及完善的程序设计。我国以往疏于对地方试验进行法律控制，全国人大常委会自2012年底开始尝试将地方试验法治化，就此可充分借鉴法国的法律制度。

Local experimentation in France was carried out since the 1960s, and since the same time the Conseil d~Etat began to exercise a judicial review on it, in order to reduce its conflict with the national legal system, and to guarantee the full use of experimental measures. The 2003 constitutional revision further confirmed the local experimentation system. The French practices illustrated that legal control system, the elements of which are definite purpose, limited dura- tion, scientific evaluation of effectiveness and perfect procedural design, is necessary to eliminate the shortcomings and make full use of local experimentation. Local experimentation in China was out of legal control, but the Standing Committee of NPC began to achieve the rule of law in local experimentation since the end of 2012, in which the French legal system could be inspiring.
