我国农村土地登记总体上呈现＂法律缺位,政策先行,回避争议,强制推进＂的特点,希望借助权利登记制的治理功能,通过完善登记实现对农村土地流转秩序的治理。但不可忽视现有登记制度的缺陷为秩序治理所形成的影响：如虚化的权利主体不能确立登记主体,分立的登记机关无法产生统一准确的登记信息,错位的效力规则无法达成一致的权利变动预期,模糊的赔偿责任导致无法划定登记权行使边界。这些障碍必须通过统一权利主体与登记机关信息、按土地的不同用途构建效力规则及完善错误登记的损害赔偿制度予以克服。

At present rural land registration system presents characterlstms oI ＂＇the absence ol law,poncy going ahead of the rest,to avoid controversy,and enforcement forcefully＂ ,intending to achieving rural land registration in comprehensive coverage. To enhancing the circulation of collective construction land and rural land expropriation system reform,there are many obstacles in rural land registration process, such as the virtual subject of the rights can not establish the registration body, separate registration authority can not produce a unified accurate registration information, misalignment of the effectiveness of rules can not reach unified agreement, right expected liability fuzzy lead to delineating the registration rights boundary. These obstacles must be overcome through unifying the subject of right and registration information, building validity rules and perfecting error compensation system according to different uses of land.
