2012年修正的《民事诉讼法》对专属管辖范围进行了扩张,进一步完备了我国专属管辖制度。但在中国境内履行的中外合资经营企业合同、中外合作经营企业合同、中外合作勘探开发自然资源合同纠纷仍然保留为由我国法院专属管辖,排除其他国家法院对该类合同纠纷进行管辖,既不符合国际通行做法,也与新增专属管辖案件存在一定程度重迭,故应根据不同情况予以重构。
2012年脩正的《民事訴訟法》對專屬管轄範圍進行瞭擴張,進一步完備瞭我國專屬管轄製度。但在中國境內履行的中外閤資經營企業閤同、中外閤作經營企業閤同、中外閤作勘探開髮自然資源閤同糾紛仍然保留為由我國法院專屬管轄,排除其他國傢法院對該類閤同糾紛進行管轄,既不符閤國際通行做法,也與新增專屬管轄案件存在一定程度重迭,故應根據不同情況予以重構。
2012년수정적《민사소송법》대전속관할범위진행료확장,진일보완비료아국전속관할제도。단재중국경내리행적중외합자경영기업합동、중외합작경영기업합동、중외합작감탐개발자연자원합동규분잉연보류위유아국법원전속관할,배제기타국가법원대해류합동규분진행관할,기불부합국제통행주법,야여신증전속관할안건존재일정정도중질,고응근거불동정황여이중구。
The newly revised Civil Procedure Law expands the scope of exclusive jurisdiction and further improves the system.However,the article that actions brought on disputes arising from the performance of contracts for Chinese-foreign equity joint ventures,or Chinese-foreign contractual joint ventures,or Chinese-foreign cooperative exploration and development of the natural resources in the PRC shall fall under the jurisdiction of the China’s courts is still kept which rejects the jurisdiction of other countries’courts.Considering the article is not only inconsistent with international practice,it also overlaps the newly added exclusive jurisdiction clause to some extent,it should be reconstructed in accordance with different specific conditions.
