货物运输合同的性质为第三人利益合同，收货人为受益第三人。目前我国铁路货物运输合同的收货人属于“经由被指令人而为交付”之第三人。为保护收货人的信赖利益，在我国未来立法上应当将铁路运输合同中的收货人确定为具有第三人利益合同之受益人的法律地位。
貨物運輸閤同的性質為第三人利益閤同，收貨人為受益第三人。目前我國鐵路貨物運輸閤同的收貨人屬于“經由被指令人而為交付”之第三人。為保護收貨人的信賴利益，在我國未來立法上應噹將鐵路運輸閤同中的收貨人確定為具有第三人利益閤同之受益人的法律地位。
화물운수합동적성질위제삼인이익합동，수화인위수익제삼인。목전아국철로화물운수합동적수화인속우“경유피지령인이위교부”지제삼인。위보호수화인적신뢰이익，재아국미래입법상응당장철로운수합동중적수화인학정위구유제삼인이익합동지수익인적법률지위。
Contract of railway freight transportation is one of the contracts for the benefit of the third parties, generally with the consignee as the third party. However, the third party is re-ferred to as ＂by the instruction and delivery＂. In order to safeguard the trust-benefit of consignee, the legal status of the consignee of contract of railway freight transportation must be identified and specified as the third party beneficiary in law of our country in the future.
