公职人员利益冲突的治理是正式约束与非正式约束的互动过程,但非正式约束是正式约束形成的基础及其失效的补充,在引导和塑造公职人员理性行为上也更具恰适性。它主要通过意识形态、传统文化、价值观念、伦理道德、习惯习俗等关键要素,影响公职人员利益冲突发生时的价值判断及行为选择。实现非正式约束的制度功效,必须通过促进社会主义核心价值的认同与自信、营造廉洁文化环境、重塑道德约束以及培育契约型人格等实施机制的保障,使非正式约束要素内化为公职人员自我约束的行为准则,做出自觉遵从公共利益优先的理性选择。

The governance of the conflict of interests of public servants is a process of interaction between formal constraints and informal constraints.Informal constraint is the basis of formal constraints and the supplement of its invalidity.It can have influence on the judgment of the public servants mainly through key factors,such as ideology,traditional culture,values,ethics and morals,habits and customs etc.,and make them choose the rational behaviors that give priority to the public interests.The effective exertion of its functional mechanism also depends on the implementation mechanism such as the promotion of identification and self-confidence of core value of socialism,the construction of uncorrupted cultural soft environment,the reinforcement of education of uncorrupted values,rebuild of moral constraints and cultivation of contractual personality etc.,so as to realize the effective governance on the conflict of interests of public servants in the perspective of informal constraints and make rational choices that consciously give priority to the public interests.
