抵押权存续期间按照是否由当事人约定,可以分为抵押权法定存续期间与抵押权约定存续期间。前者是由法律直接规定的,后者是当事人由在法律规定的范围内约定的。当事人有约定抵押权存续期间的自由。法律对当事人所享有的约定抵押权存续期间的自由应从期间起算点、长短、登记等方面加以规制。
牴押權存續期間按照是否由噹事人約定,可以分為牴押權法定存續期間與牴押權約定存續期間。前者是由法律直接規定的,後者是噹事人由在法律規定的範圍內約定的。噹事人有約定牴押權存續期間的自由。法律對噹事人所享有的約定牴押權存續期間的自由應從期間起算點、長短、登記等方麵加以規製。
저압권존속기간안조시부유당사인약정,가이분위저압권법정존속기간여저압권약정존속기간。전자시유법률직접규정적,후자시당사인유재법률규정적범위내약정적。당사인유약정저압권존속기간적자유。법률대당사인소향유적약정저압권존속기간적자유응종기간기산점、장단、등기등방면가이규제。
As to whether the parties of the right to mortgage have the freedom to make agreement, the duration of the right to mortgage is divided into contractual time limitation of right to mortgage and legal time limitation of right to mortgage. The former is directly regulated by law;the latter is contracted by the party in the legal scope. The party has the freedom of contractual time limitation of right to mortgage. According to law, the parties may prescribe the starting point, length and register of contractual time limitation for the right to mortgage.
