竞争不仅是提高高等教育质量的重要手段,而且也是提升一国高等教育国际竞争力的前提和基础,因此有越来越多的国家重视高等教育领域中的竞争。不管是根据竞争的基本要求判断,还是根据高等教育竞争本身的特点判断,现行高等教育治理结构尚有许多因素不利于高等教育竞争。为了释放高等教育的竞争活力,立法必须在外部治理结构方面完成从假二元结构即所谓的政府——高校结构向真三元结构即政府——教育中介组织——高等学校结构的转变,使三元结构中的每一元都成为高等教育活动中真正独立的利益主体,在内部治理结构方面必须明确相关利益主体的治权、强化大学章程的作用并确保内部治理结构的长期稳定。

Competition is not only an important means to improve the quality of higher education,but also the premise and foundation to enhance the international competitiveness of higher education in a country.Therefore,more and more countries pay attention to the competition in the field of higher education.No matter judging from the basic request of competition,or according to the characteristics of the higher education competition itself,there are many factors in the current governance structure of higher education going against higher education competition.In order to release the competitive vitality of higher education,from the perspective of external governance structure,the legislation must be transformed from false dual structure of the Government-University to true ternary structure of the Government-Intermediary Organization-University.The legislation should make each party in the ternary structure become truly independent interest subjects in higher education activities.In the internal governance,we should make the relevant stakeholders enjoying administrative power,strengthen the role of University Charter and ensure the long-term stability of internal governance mechanism.
