配偶权与隐私权的冲突是婚姻家庭领域配偶权保护的一大难题,立法途径和司法途径是解决法律冲突的两种方式。传统的解决方法更多的是依据法律价值位阶的高低进行比较,优先保护隐私权。这种一刀切的解决方法单一武断,在复杂多样的社会生活中,不能有效维护配偶的权利。虽然现在制定《人格权法》的呼声很高,但是通过立法途径解决配偶权与隐私权的冲突并不现实,所以通过司法途径,由裁判者在具体案例中行使自由裁量权来进行利益平衡,无疑是更为合适和经济的解决方式,但是要注意避免隐私权扩大保护的倾向。只有合理解决配偶权与隐私权的冲突,才能有效保护配偶间合法的权利,建立健康和谐的社会主义婚姻家庭关系。

The conflict of spouse rights and privacy is a difficult problem to protection of spouse rights in the field of marriage and family.The legislative approach and the judicial approach are two ways of solving legal disputes.The traditional solution tends to compare according to the hierarchy of the legal value and protect privacy preferentially.The cookie-cutter approach is single and arbitrary,so it can’t maintain spouse rights effectively in the complicated and various social life.Though people strongly call for legislation of Personality Rights Law,it is impractical to solve the conflict of spouse rights and privacy by way of the legislative approach.It is more appropriate and economical for judges to use discretion to balance interests in specific cases by means of the judicial approach undoubtedly,but the tendency to protect privacy expansively should be avoided.It is necessary to settle the conflict of spouse rights and privacy reasonably,in order to protect legitimate rights between spouses effectively and establish healthy and harmonious socialist marriage and family relations.
