通过对西安市环境纠纷案件的分析，指出当前法院在化解环境纠纷案件中面临的尴尬、困境及原因；提出要全面强化司法保护环境功能，必须合理配置审判职权，细化公益诉讼程序机制、完善环境纠纷受理及审理制度、充分发挥最高法院的司法解释和指导性案例功能，加大运用刑法手段保护环境的力度；同时，中国立法机关应加强与环境保护法律法规相配套的地方性立法工作，多方合力共促法院公正高效审理环境纠纷案件。

From the analysis of cases of environmental disputes in Xi＇an, we point out the dilemma position, predicament and reasons of the courts to defuse cases of environmental disputes. We propose that when intensifying in an overall way the function of the courts to protect the environment, it is necessary to reasonably allocate the trial of authority, segment the mechanism of public interest litigation procedures, perfect the accepting and hearing system of environmental disputes, bring into full play the function of the supreme judicial court to make judicial interpretation and provide guiding cases, and increase the force to protect environment by applying the criminal law means. At the same time, we suggest that Chinese legislative body should strengthen local legislations matching with the laws and regulations for environmental protection and make multi -party concerted efforts to promote the courts to try the environmental cases efficiently.
