先秦儒家文化对国人有着深远复杂的影响，并进而影响着现代中国社会的法治建设进程。先秦儒家提出的民本、公平、慎刑、预防犯罪等思想，与现代法治精神高度相契合；而其强调的无讼、德主刑辅、等级、义务本位等思想，则与现代法治精神有所背离和冲突。在构建现代法治社会的过程中，既要积极汲取先秦儒家思想中与现代法治精神相契合的精华理念，又需克服其与现代法治理念相冲突的过时内容。
선진유가문화대국인유착심원복잡적영향，병진이영향착현대중국사회적법치건설진정。선진유가제출적민본、공평、신형、예방범죄등사상，여현대법치정신고도상계합；이기강조적무송、덕주형보、등급、의무본위등사상，칙여현대법치정신유소배리화충돌。재구건현대법치사회적과정중，기요적겁급취선진유가사상중여현대법치정신상계합적정화이념，우수극복기여현대법치이념상충돌적과시내용。
The Pre - Qin Confucian culture is still exerting great and complicated influence on the modem Chinese people, and furthermore on the course of legal construction of modem Chinese society. The thought of people - orientation, justice, prudent penalty practicing, prevention of crime, etc. is in great coincidence with the spirit of modem ruling by law. However, the thought focusing on no litigation, morality given priority over penalty, social classes, obligation ori- entation, etc. deviates from and conflicts with the spirit of modem ruling by law. In the forming of the modem society of ruling by law, it is mandatory to not only take in the quintessence ideas of the pre - Qin Confucian culture that coincides with the spirit of modem ruling by law, but also overcome the outdated contents that are in conflict with the ideas of modem ruling by law.
