深圳首例＂砸窗查酒驾＂案引发了对强制法颁行之后警察应该如何强制行使道路交通安全检查权问题的思考。道路交通安全检查权的强制行使受到了行政强制法合法性的挑战,而对这一职权的现实需求并未明显降低。通过分析行政检查、调查、强制三者之间的关系,提出选择制定行政程序法,或清理完善人民警察法、道路交通安全法、公路法来解决这一问题,使其既为警察履行法定职责提供必要的保障,也为公民享有基本权利提供最大的保障。

The first case of inspectiong drunk-drive by smashing car-window aroused the reflection on the question： How do the police should execute inspection power of road traffic safety.The legitimacy of inspection with the use of force has been challenged by the establishment of administrative coercion law while the need for its use has not been decreasing at the same time.By analysing the relationship among administrative investigation,inspection and coercion,the establishment of administrative procedure law or clearing and perfection of the people＇ s police law,road traffic safety law and road law should be chosed to solve this problem,so as to necessarily guarantee the traffic police＇ s executing inspection power and most safeguard the citizen＇ s fundamental rights.
