目前，食品安全事故发生后对受害人的救济多适用民事赔偿、责任保险、社会保障等制度，但这些救济制度都存在一定的局限性，而补偿基金法律制度具有的公益性、补偿性、及时性等特性和功能，可以较好地解决在实践中受害人无法充分及时得到损害赔偿的问题。因此，应明确补偿基金支付申请的条件和补偿基金的支付范围，设计合理的补偿基金支付程序，确定补偿基金适用的序位，设置可行的补偿基金管理机构模式。
